Waiver of Liability, Assumption of Risk, and Indemnity Agreement

In consideration of participation at XTREME Fitness, Cheer & Tumbling, LLC, I represent that I understand the nature of this Activity and that I am qualified, in good health, and in proper physical condition to participate in such Activity. I am allowing the gymnast to participate in sports activity, class, competition, team, including non-gymnastics activities, such as dance, cheerleading or playground activities (hereinafter referred to as the "Activity"), and if I am not yet 18 years old, my parents or legal guardians agree to be bound as follows (the term "I" in this release refers to both the gymnasts and his/her parents or legal guardians). I acknowledge that if I believe event conditions are unsafe, I will immediately discontinue participation in the Activity.

I fully understand that this Activity involves risks of serious bodily injury, including permanent disability, paralysis, and death, which may be caused by my own actions, or inaction, those of others participating in the event, the conditions in which the event takes place, or the negligence of the "releasees" named below; and that there may be other risks either not known to me or not readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for losses, cost, and damages I incur as a result of my participation in the Activity. The risk of injury also includes, but not limited to, minor injuries such as bruises, and more serious injuries such as broken bones, dislocations, and muscle pulls.

I hereby release, discharge, and covenant not to sue XTREME Fitness, Cheer & Tumbling, LLC, its respective administrators, directors, agents, officers, volunteers, and employees other participants, any sponsors, advertisers, and, if applicable, owners and lessors of premises on which the Activity takes place, (each considered one of the "Releasees" herein) from all liability, claims, demands, losses, or damages, on my account caused or alleged to be caused in whole or in part by negligence of the "releasees" or otherwise, including negligent rescue operations and future agree that if, despite this release, waiver of liability, and assumption of risk, I, or anyone on my behalf, makes a claim against any of the Releasees, I will indemnify, save, and hold harmless each of the Releasees from any loss, liability, damage or cost which any may incur as the result of such a claim.

I have read the RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY, understand that I have given up substantial rights by signing it and have signed it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid, the balance, notwithstanding, shall continue in full force and effect. I certify that the participant is covered by insurance to cover any injury or damages he/she may suffer or cause, or else I agree to bear the costs for such injury to myself or others. I am executing this document voluntarily and with full knowledge of its significance.

Coronavirus/Covid-19: The novel coronavirus, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to be spread from person-to-person contact. XTREME Fitness, Cheer & Tumbling, LLC ("the Club") cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending the Club could increase your risk and your child(ren)'s risk of being exposed to COVID-19. By accepting this agreement, I voluntarily agree and understand the risk of becoming exposed or infect by COVID-19, and accept sole responsibility for any occurrence to my child(ren) or myself; I hereby release, covenant not to sue, discharge, and hold harmless the Club, its employees, agents and representatives.
